Applying Under the Ley de Nietos?

The Ley de Memoria Democratica (2022) - commonly called the “Ley de Nietos” - allows grandchildren and great-grandchildren of Spanish emigrants to claim citizenship by origin.

DELE A2 is a mandatory requirement for most applicants.

What you need to know:

  • DELE A2 must be passed before your citizenship application is submitted.
  • The exam is offered 6 times per year - your application window depends on your exam date.

Legal residency for 10 continuous years is the standard route to Spanish nationality - and DELE A2 is the language gate you must pass before your application is accepted.

What you need to know:

  • DELE A2 is mandatory for naturalization applications via residencia (Art. 22 Codigo Civil).
  • Your residency clock does not stop - but your application cannot proceed without a valid DELE A2 certificate.
  • Certificate validity: DELE A2 does not expire - once you pass, it counts permanently.
  • CCSE is required separately - same exam period, different registration at Instituto Cervantes.
  • Processing times are often 12-24 months - passing DELE A2 now does not delay your application, it unblocks it.

  • EU citizens with 10+ years legal residency in Spain.

From Latin America? You Only Need 2 Years of Residency.

Citizens of Latin American countries, the Philippines, Equatorial Guinea, Andorra, and Portugal qualify for Spanish citizenship after just 2 years of legal residency - not 10.

That is the good news.

The catch: DELE A2 is still required, even if Spanish is your first language.

What “native Spanish speaker” does NOT mean:

Many Latin American applicants assume they are exempt from DELE A2 because Spanish is their first language.

They are not.

The language exemption applies only to citizens of Spanish-speaking countries for the CCSE exam - not for DELE A2.

DELE A2 is required for all naturalization applicants regardless of native language.

What this means in practice:

  • You still need to register at Instituto Cervantes.
  • You still need to pass 4 sections with minimum 30% each.
  • The exam is in Castilian Spanish - regional accents and vocabulary differences can affect listening comprehension.
  • Most Latin American candidates pass on first attempt - but only if they practice the specific exam format.

The typical timeline for 2-year residency applicants:

  1. Confirm 2-year residency via empadronamiento certificates.
  2. Register for DELE A2 as early as possible - exam slots fill up months in advance.
  3. Prepare 2-4 weeks (native speakers) focusing on exam format, not language.
  4. Pass DELE A2 + CCSE.
  5. Submit naturalization application.
